TR EAEU038/2016 on the Safety of Entertainment Equipment
Regulatory Overview
TR EAEU038/2016 is a technical regulation issued by the Eurasian Economic Union (EAEU) regarding the safety of amusement equipment. This regulation aims to ensure that amusement equipment meets certain safety standards during design, manufacturing, sales, and use, thereby safeguarding the personal and property safety of consumers when using such equipment. It also promotes free trade of amusement equipment among EAEU member states and eliminates trade barriers caused by differences in safety standards among countries.

Scope of Application  
TR EAEU038/2016 applies to all types of entertainment equipment, including but not limited to amusement park facilities (such as roller coasters, carousels, Ferris wheels, and other large-scale amusement rides), video game equipment (such as arcade machines, home video game consoles, etc.), children's play equipment (such as slides, swings, seesaws, etc.), and other equipment with entertainment functions. However, certain types of entertainment equipment may be subject to additional regulations or exemptions under other relevant regulations or standards, and specific circumstances must be determined based on the detailed provisions of the regulations and relevant interpretations.

Main Safety Requirements
Design and Manufacturing Safety
Structural Stability: The structural design of entertainment equipment must ensure sufficient stability under normal use and anticipated abnormal conditions (such as overloading, strong winds, etc.) to prevent equipment collapse or structural damage. For example, the tracks and support structures of roller coasters must be able to withstand the pressures caused by high-speed operation and various complex movements.
Material Selection: The materials used should have sufficient strength, durability, and safety, and should not include toxic, harmful, or materials that may cause harm to the human body. For children's amusement equipment, materials should also comply with relevant hygiene standards to prevent allergies or other health issues from occurring after children come into contact with them.
Safety Devices: Amusement equipment should be equipped with necessary safety devices, such as safety barriers, seat belts, and safety nets, to prevent users from falling, colliding, or sustaining other injuries. For example, each seat on a carousel should be equipped with a reliable seat belt.  
Electrical Safety  
Insulation Performance: If amusement equipment includes an electrical system, its electrical equipment and wiring should have good insulation performance to prevent electrical leakage accidents.
Grounding protection: Effective grounding protection measures must be in place to ensure that in the event of an electrical equipment malfunction, current can be diverted into the ground to prevent electric shock to personnel.
Electrical component quality: The electrical components used should comply with relevant safety standards and have good performance and reliability.
Mechanical safety
Moving part protection: Moving parts of amusement equipment (such as gears, chains, belts, etc.) should be protected to prevent personnel from coming into contact with moving parts and sustaining injuries.
Braking Devices: Entertainment equipment requiring stopping or deceleration must be equipped with reliable braking devices to ensure the equipment can stop within the specified time.  
Signage and Instructions  
Safety Signage: Entertainment equipment must clearly display safety signage, such as prohibition signs, warning signs, and instructional signs, to remind users of safety precautions. For example, a sign stating ‘Children under 1.2 metres in height are prohibited from riding’ should be placed at the entrance of a roller coaster.
User Manual: A detailed user manual should be provided, including instructions on equipment installation, operation, maintenance, and care, as well as safety precautions and emergency response procedures.

Certification Requirements
Certification Modes
Enterprises should select appropriate certification modes based on factors such as the type of amusement equipment and production scale. Common certification modes include type certification, batch certification, and production process certification.

Certification Process
Application: Enterprises submit certification applications to certification bodies recognised by the Eurasian Economic Union (such as Shanghai Jinghe Industrial Equipment Testing Co., Ltd.) and provide relevant technical documents and product information.
Document Review: Certification bodies review the documents submitted by enterprises to ensure compliance with regulatory requirements.
Product Testing: Safety tests are conducted on the entertainment equipment, with test items determined based on regulatory requirements and product characteristics.
Factory Audit (if necessary): The certification body may conduct an on-site audit of the company's production facility to verify compliance with regulatory requirements.
Certificate Issuance: If both product testing and audits are passed, the certification body will issue the TR EAEU 038/2016 certification certificate.

Regulatory Implementation and Supervision
Implementation Timeline
After the TR EAEU038/2016 regulation takes effect in all member states of the Eurasian Economic Union, manufacturers, importers, and sellers of entertainment equipment must ensure that their products comply with the requirements of this regulation. Member states should transpose this regulation into domestic law within the specified timeframe and implement it in accordance with uniform standards.

Supervision and Inspection
The relevant regulatory authorities of the member states of the Eurasian Economic Union will conduct supervision and inspection of entertainment equipment on the market to ensure that products comply with the safety requirements of TR EAEU 038/2016. For products that do not comply with the regulation requirements, the regulatory authorities have the right to take measures such as ordering rectification, recall, or fines to ensure consumer safety.
